HR tip: The disappearing employee – not turning up to work

Question:
"An employee has just stopped coming to work, though has been seen around town. After how long can we assume that he has resigned?"

HR tip:
You may accept that an employee has resigned only if he or she tells you that they have resigned, otherwise employment continues until one or other of you terminates it.

Your employee has behaved badly by not attending work and not notifying you or giving a valid reason. You should therefore operate your disciplinary procedure by writing to his last known address, inviting him to a disciplinary hearing to deal with his unauthorised absence.

If he fails to attend, write again giving a few days notice of another hearing and explaining that, should he fail to attend or make any submission, you will hold the hearing in his absence. If he fails to attend that meeting without giving good reason, you may safely terminate his employment for gross misconduct.
