Due to an error – an offer letter set out a 12 week probation period, whereas attached ‘T&C’s stated 26 weeks.

After 25 weeks, needs changed and the company wants to set fresh objectives and extend probation.

The employee indicated this is unacceptable and is requesting the much longer “post probation” notice period – arguing she relied upon the terms in the offer letter taking precedence over the attached ‘T&C’s

The letter states regular reviews would take place, and the employee would receive written confirmation upon completion of probation.

No reviews took place, and no confirmation was issued.

Which probationary period applies?
