A senior employee gave notice and because they wanted to begin their new job in January, requested a shorter notice period (1 month) to the 3 months stipulated within their contract. This was agreed.

They are now saying that we should pay them in lieu of the 2 months they are not working – surely because we have agreed to waive their contractual notice period we do not have to pay them?
