Competence in the workplace

I am currently researching my Thesis for my Masters degree in Commercial Law. I am trying to determine how various organisations identify employee competence, so satisfying the requirements of the HASAWA. Why do organisations fail in this area – is it because of ignorance, or is it deliberate. Any comments?
