We become stuck on the issue of whether or not we are allowed to not interview a candidate who is very pregnant for a vacancy for which they could otherwise do, on the basis that they would not be able to meet the needs of the position as they would shortly be on Maternity leave.
Does business have a case for this based on “business needs” or should we in practise always interview pregnant women to be safe.
Does a 6 month pregnant women who posesses the necessary skills have a right to be interviewed? Is there any protection against claims of sex discrimination in such a cirumstance?
