I know there are a lot of threads on this topic already but none of them match my circumstances enough so thought I’d write direct for some advice.
I have been working for my employer for 5mths now but recently moved roles and dropped to part time (until Christmas). I am due to do one day’s training on Thursday and today received a letter stating the fees are repayable if I leave within 2yrs of completing the course (33% after one year). My colleague and friend who did this training a while back did not receive such a letter and she started about 3 weeks before me. I have a feeling it’s because I originally resigned, then disclosed to my line manager that I was struggling with the poor work load (not enough to do despite asking!) and part time was offered…the disclosure of my ‘problems’ was kept confidential between my line manager, manager and one person in HR (not the person this letter came from).
It doesn’t appear to be an ‘amendment to contract’…my contract isn’t mentioned at all, and this repayment factor isn’t mentioned in my original employment contract. It appears to be about terms of funding and it asks me to sign to confirm my agreement. Can I just not sign it as then I’m not agreeing to the terms? This seems to be what ACAS suggest. While I’m not planning on a change just yet, I may be moving in a year anyway when my partner relocates.
Any advice would be greatly appreciated. Thank you in advance
