My client runs a small courier business and employs three drivers. Drivers are paid monthly in arrears. Each driver has a contract that states ‘during the three month probationary period one weeks notice is required by either party in order to terminate the employment’.
On 27 April after eight weeks employment a driver decided that he didn’t want to work any longer and at 8.30am handed the keys of his van back to the employer. This caused total chaos, an agency driver had to be called in and deliveries were late causing the company to be fined.
The driver had been paid up until the 16 April so technically is due payment for six days. Does my client have to pay all of this?
