I need to change the rostered day off of one member of staff in order to reduce the need for other personnel to cover this area. She has refused and has lodged a compliant with The Board of Trustees stating that if the change goes ahead she will bring a case for constructive dismissal. Nothing else is changing, her hours and salary will remain the same and after the change she will have every weekend and bank holiday off and will finish one hour early two days per week. Currently she works every Saturday and alternate bank holidays. Can she reasonably refuse this change and would she have a case for constructive dismissal if it went ahead and she left?
