Would anyone be willing to share with me common practise on redundancy payments for Spanish employees. I have recently joined a company and see that the policy has been locally driven. This policy is to use the legal guidelines around unfair dismissal and offer a mutual agreement and pay 45 days per year of service up to max 42 months because the legal redundancy requirement of 20 days per year of service [to max 24 months] would mean a very long legal case and may not get approval from Court to make the person redundant. If length of service is long this could mean paying almost 2 years salary. This payment seems excessive to me so I would like to change to 20 days per year of service etc. However I would need to know what is common practise and how long does it really take to get approval to make a redundancy.
