I have been tasked with issuing contracts / statements of particulars to employees as these have never been issued (we are a very small production / engineering business who needs to come into this century!).
Employees are required to work overtime as and when required and this will form part of the statement of particulars. However, we have a small number of employees who refuse to work the overtime as they have signed no ‘contract’ and will not accept the issued statement of particulars with this clause! We need these employees to work overtime (paid). If they don’t work these hours senior managers say there is no role for them?
Please help – where do we stand? – can we insist they do the overtime? (they have in the past)as the role without overime is detrimental to the business.
