We have a member of staff that suffers from Bi-polar (declared and fully supported since in November 2009). However recently, there have been changes to his mood and behaviour. The member of staff suffers from depression, feelings of self-harm, hallucinations. On occasion, the member of staff has sent inappropriate and racist emails to colleagues and demonstrated violent behaviour towards other members of staff. On other occasions, the member of staff has compromised the safety and security of staff/clients by leaving the centre unattended or visiting the centre out of office hours and leaving the lights on and not locking security doors.
We have medically suspended the member of staff (full pay) pending reports from his psychiatrist and GP. A large portion of his job is working with live electrics.
The Company has considered a range of suitable alternative options unfortunately, none were truly suitable. There are real concerns on how to continue to support this member of staff given his conditions with some of the behaviours and actions which has escalated in recent months.
The Company would like to dismiss but I cannot see a fair way to dismiss without impacting on Equalities legislation. Financial constraints makes it difficult to agree to terminate the contract of employment with a substantial payment and compromise agreement.
Please let me know what other options are available.
