I have a key employee in one of our locations who has been employed by us for just over 4 months. In this time there have been 27.5 days sickness, various symptoms not related and randomly spread over the time. This employees absence can no longer be bourne by the local staff and it is causing a loss of business to us and we are desperate to get a new staff member in place.

This employee has now been signed off with Glandula fever for a period of time, probably ongoing. Normally this absence problem would have been dealt with in probationary reviews, however, she has missed all but one of these appointments – due to sickness. Am I in a position to terminate her contract with full regard to notice periods and payment etc.

Any advice anyone could give would be much appreciated.
