I have conducted an investigation into allegations that have been made of a Ltd company contractor. They are claiming that under the employment rights act they are entitled to a formal process and have the right to be accompanied. I am reluctant to do this as it suggests they are more of an employee. Whilst I beleive that before we make any decision about dismissal that I satisfy myself that a fair process has been followed I do not want to treat it like a disciplinary with appeals stages etc. The individual has less than 1 years service and I do not believe therefore that any of this applies.
