We have a staff member who has recently passed their probation period (1 weeks notice) and entered into a full contract (3 months notice).

They have recently advised that they now wish to terminate their employment, but do not wish to work their full contractual notice period. They wish to give 1 months notice at most, and prefer to give 1 week.

Much is made with regards the employer’s liaibility under breach of contract in upholding notice periods, but where do we stand as an employer in insisting an employee fulfils their obligations? What action could we take if this was not fulfilled?
