I am trying to write a condition of employment that says the right to work in the UK will be checked annually and failure to provide proof of a continuing right to work will result in dismissal. Should this dismissal be with or without notice? Could we add failing to have a continuing right to work to the list of Gross Misconduct issues or would it require contractual notice.
