This is a situation which we have encountered in the past and never found a satisfaction answer.
Our employment contract specifies that employees must give one calendar month’s notice. We work in an industry where there is a very strict ratio of staff imposed by our regulators. If we let people go early, we would be breaching this ratio if we have not found a replacement. Given that most suitable replacements also have to give a month’s notice with their current employer, we have 2 questions:-
a) Why should we let employees leave with less than their contractual month’s notice?
b)If they refuse to stay for the full month and leave after, say 3 weeks, what recourse do we have regarding pay?
Employee has given notice today and wants to leave on 17th August. A calendar month would be the 26th August.
