I would be very grateful of any advice you can give me on this matter.
I submitted a grievance to my employer in Feb07, then because the situation got worse and was not dealt with, I went off work with stress. The doctor signed me off until Aug 15th when I took it upon myself to return, against the advice of my doctor because I wasn’t being listened to while off sick and it wasnt making me feel any better.
On my return, my colleague (who was the cause of the initial grievance) submitted a grievance against me. It was then that I found out that anything that I had previously submitted was not being treated as a grievance!! Despite phrases in my letter such as “I feel aggrieved..” and I termed my complaints as “my grievances”. The HR dept advised me to resubmit everything with “This is a formal grievance” written on it!
Anyway, I did this and they investigated and decided that apart from they admitted that the whole situation had been mismanaged, the rest of my grievance was not going to be upheld due to lack of evidence. Throughout all of this I have kept a detailed diary of events plus all emails etc. Does a diary count as evidence?? They even denied receiving my formal letter to the HR dept detailing my grievances, however I have since discovered that they are trying to cover up as I have proof in an email that they have received and acknowledged the letter!
They have decided that the majority of my colleagues grievance against me cannot be upheld either apart from one incident which I have denied which involved me swearing at her during an argument in SUMMER 2006! She cannot provide a date! This is the woman who swore so much she had a swear box on her desk! Apparently this was witnessed by another colleague (her friend) but neither wrote notes or complained at the time.
My employer has written to me to inform me of a disciplinary hearing for “using abusive language and bullying behaviour”. Does one argument amount to this? I am adament that I did not swear at her.
Can they really even hold a disciplinary for an incident a year and a half ago, with no dates, nothing in writing, just on the statement of two colleagues who are also friends?
Any guidance would be greatly appreciated.
