Hi,

An employee who is has a live Final Written Warning and is  about to progress to the final stage of the Disciplinary Process, has applied for another job with a new employer. They requested a reference from one of our Managers who they believe to be the employee’s Line Manager. Under the section requesting disciplinary information, the referee has stated "none known personally". The potential new employer are under the impression that the reference is coming from his line manager they are happy to accept the contents of it.

HR know that the referee is not the employee’s Line Manager, and we also strongly believe the referee IS aware of the current ongoing disciplinary.

Do we have an obligation to rescind the reference and provide another one?
