I am working with a client mentoring an young HR assistant through her CIPD examinations and when we were doing some work on ‘Statements of Terms and Conditions’ for the organisation she said she had been told by her tutors that there was case law that said if the word ‘contract’ was not included in the statement it could be held against the employer at a tribunal. I have never heard this in my 30 years in HR and have always issued offer letters and ‘statements of terms and conditions’ which do not use the word contract. Is this wrong??
