I am trying to establish whether this is a case of Breach of Contract/Wrongful Dismissal.

I had worked for a company for 5 months.  Each month I won awards.  100% attendance, even when we had snow and others didn’t make it in.

I worked alongside someone who I found very difficult and was prone to tantrums/inappropriate behavior.

Having discussed the matter with the HR Manager, he had suggested I raised it in my appraisal in March and offered to look over my appraisal before I submitted it to the MD.  The person I worked with only worked part time.  The appraisal asked what you did over and above your normal duties.  I had said that 2 days per week, I also covered the work for my colleague. The HR Manager had suggested I gave an example of this, which I did.  He told me he thought my appraisal was fine, with nothing untoward in it.  He said he would back me.

The upshot was my appraisal with the MD was not good.  He was particularly unhappy that I had given an example, as he felt this was petty. He later called me to his office and dismissed me.  The letter I was given stated that it was on the grounds of my negative attitude towards work.

I appealed and stated all the positive things I had done and the awards I had received. I then attended an appeal meeting at which nothing was said about my alleged negative attitude and was told that I had been dismissed because I go into too much detail!  I subsequently received a letter saying that the decision was upheld due to my negative attitude.

I understand that unfair dismissal cannot apply under 12 months, but as no procedure has been carried out and on their Grievance & Disciplinary Procedures it states that they are non-contractural, would breach of contract be applicable?
