We have a Foreman who for various reasons, wishes to return to driving. We do not have any driving vacancies and do not want to lose this person.

A job swap with a driver who covers the foreman’s position on an ad hoc basis has been proposed.

Are there any legal implications to not advertising the position(s)internally and proceeding with the job swap.
