I started work at a company last Monday, and in the contract it says that during the 3 month probation period the employee must give one months written notice – but the employer only has to give a weeks notice for dismissal. This did not bother me until I started work, wherein I have found the office conditions to be extremely unpleasant, with a number of incidents of sexual harrassment, mild bullying and absolute neglect of a new starter (me), but none which are serious enough for me to wish to make any allegations that might lead disciplinary action for the accused. I also rushed into accepting a job that I did not know the full details of (and was not told exactly what they were) – it is a sales role, something I am extremely unhappy doing and mentioned as much in my interview. This was disregarded when I mentioned it to my manager on my first day, and I was told to ‘get used to it’ despite clearly stating I was unhappy.
I have made every effort to rectify my working situation, asking to be moved to another team that is mainly women and is less about sales; this has been met with indifference and I have been told that I will ‘get used’ the working environment where I have to put up with sexual innuendo (directed at other female staff) from my three male team mates whilst they brag about their sexual conquests and are generally unreasonably crude.
Clearly I do wish to leave as soon as possible as the job is causing me a great deal of emotional and mental trauma (I have not slept all week and was physically sick with stress at one point.)However my contract requires that I give one months notice. I do not feel that I can physically stay for another month so am inclined to ask to leave with a weeks notice and forfeit any extra pay (I get paid next Monday so if they accept my shortened notice period I would go away having been paid for two weeks work).
What are my rights in this situation? Obviously I do not want to cause myself further angst or put myself into a worse situation by voicing that I wish to leave after one week’s employment, but I feel desperately that I cannot continue to work there.
