Following an allegation of sexual harassment an employee was suspended from work on full pay. Following investigation the vast majority of the allegations were found to be untrue although he was found to have used “inappropriate language”. The woman who brought the allegations was disciplined for bringing allegations “not in good faith” and her partner was also disciplined for threatening behaviour against the worker who was suspended. To have all 3 working together was felt to be inadvisable so the suspension has continued for almost 4 months now. The suspended worker is claiming victimisation. Does he have a case?
