I have just started a new job and find that all the staff work through lunch and finish half an hour earlier. The contracts do not stipulate any start, finish time or break times.

I am aware this contravenes the WTD legislation but if the staff choose to do this does it make a difference?

I think the risk of a claim would be small and if it happened, it would be from a disgruntled employee who tries to say we did not allow a break ( we would try to show they left early instead but clearly this is not what the legislation intends).

As I have just started here, I don’t want to rock the boat too much but I feel as though I should make my employers aware of any risk.

Does anyone have any observations about this? I would be really interested in people’s views
