I won’t bore you with every little detail, but my friend and colleague at a London NHS Trust faces the following situation:
The Trust is commissioned by the local PCT to provide certain dental services at Dental Access Centres. This funding is being removed by the PCT, but the PCT is not going to employ the dental staff themselves.
Instead the PCT will commission the Dental work from perhaps BUPA, Nuffield and private practices. Some staff work fully or partly under the services being removed.
As the service and the money is not being moved to one other employer and retaining its identity, but instead being scattered, is there a TUPE transfer involved?
Is this instead a redundancy situation, with either the Trust (as contractual employer) or the PCT (funding the service and all their salaries) liable?
