An employee has raised an issue where his offer letter states that he has one month’s notice (either side), but his contract states he has two months notice either side (signed by both employer and employee). For his own benefit he would like to maintain the two month agreement. However we would like to maintain the one month agreement (which was intended originally). Is the contract of employment binding in this case and therefore must we accept this two month agreement?
