I don’t know if anyone is able to clear a couple of questions up for me on the law around promotions for people who have more that 1 year’s service with us.

At the moment, when anyone moves to a new position we issue them with a letter confirming their new role and salary. We also say that they are on a 6 month probationary period and that at the end of this their performance will be assessed. Should they not be successful they will revert to their ‘previous role with its associated terms and conditions’.

My question is, are we able to turn around at any point during this probationary period if we feel things are not working out and let them know that they have not been successful and will therefore be reverting to their previous role?

Any advice or thoughts on this would be really appreciated as I am getting myself in a bit of a pickle!
