I work for the NHS in Information Management and technology. I am contractually obliged to spend a week on-call as a standby IT technician, one week in five. If I am called in to offer IT support out of hours (8.00am-5.30pm)I am paid £6.22 for every hour or part of every hour worked. This is at least two pounds an hour less that my normal hourly wage. It seems incredulous to me that I can be paid less than my normal hourly wage to perform what is essentially overtime
When I am called out to work at night or the weekend this is work performed beyond my contracted 37 hours per week. This must be viewed therefore as overtime. Is this correct? And if so is my employer in breach or employment regulations.
