A company I am familiar with, last year transferred in some work from a third party and the employees TUPE’d across on the same T&C’s. The work they do is distictly different from other roles in the organisation which are on argubly better T&C’s. All roles serve the same customer.
A problem has arisen in that we now, through turnover and internal promotion, need to recruit into the roles that were TUPE’d over. The Trade Union are adamant that any new recruits to the organisation come in on the more favourable terms of existing staff rather than the terms that the roles transferred over on.
I would be grateful for any help or suggestions.
