I have a client who is on Maternity Leave with 7 and a half months to go before she is due to return to work. She is currently suffering from Post-Natal Depression and has been told her job role,is being made redundant. The company have offered her the chance to apply for a different role, but she is too ill currently to contemplate doing this. What is the position – can she be made redundant while on Mat Leave, what happens if she is unable to go through the selection process? What about the DDA? If she cannot take up the offer to apply for another post, does this make her resundant by default? How fair is this, considering she is certificated as ill with depression? Is this not possibly discriminatory? OH would advise that she is not fit to apply, attend interviews etc. and to wait until nearer her time of return to assess her fitness to return to work, but this is clearly not an option if her job is going right now. I would appreciate some advice please.
