Can anybody help me to find a piece of case-law regarding employer responsibility at work-related social events? In particular I am trying to find the case regarding a claim of sexual harrassment to a Chief Constable following a ‘leaving do’ or some sort of after-work gathering. I believe the initial defence was that because it was not arranged by the Constabulary it was not their responsibility – but the legal decision was that because they were work colleagues, it was the responsibility of the employer.
Hope that’s enough information for somebody out there to know what I mean – don’t bother asking why I need to find it…….
