My sister-in-law has been on long term sick leave since December 2004, (supported by Dr. Certificates and more recently by incapacity notice) she had a meeting with her company director to discuss her situation and they asked permission to contact her doctor which she gave. The doctor has said that he thinks it is unlikely that she will be able to return to work within their requested timescale (ie in the next couple of months). She has just received a letter from her employer terminating her employment as of 28th March 2006. There is no mention of the 3 months notice or payment in lieu as stated in her contract of employment. They have sited her capability as reason for termination. Can they terminate her employment in this manner with no notice period or offer of remuneration.
