We have an employee who has provided a written statement giving evidence against an ex employee.
The ex-employee is now taking the case to a tribunal.
The employee who gave the statement has been asked by our legal team to appear at the tribunal to give evidence against the ex-employee, but has now gone off sick and cannot be contacted. We believe that this person is trying to avoid attending.
What can we do? Does this employee have to attend? How long can we ask for an adjournment?
Answers greatly appreciated.
