I have been off work with a back injury since jan 17th. This is certificated by my GP. My absence started after the payroll cut-off point, and as such I was paid for the whole of January. I had a letter from my company informing me of this, and that it would be recovered from my next months salary. I have still not returned to work and all SSP that I have been due, has been kept by my company to make up the loss of over paying me in January. Is this legal? as I have asked other people and got different replies. I have endured particular hardship due to this as I have a teenage daughter living with her mother, to support(maintenence), as well as normal bills. The company are aware of this.I have had no written communication from my company saying that they would be taking my SSP.To this date (29/03/05)the only communication from my company was a verbal comment from an HR Manager during a call that I made to them stating that ‘I should have budgeted for it!!!!! and it makes good business sense to not pay it to me in case I leave the company’. Would this form a good basis for issuing a grievence against the company or HR manager or is there something else I can do? any help greatly appreciated.
