I broke my toe and was signed off work for 4 weeks. Went back to hospital and was signed off for another 2 weeks. Had sick notes for both of these. While off for 2nd time my employer phoned and asked when I was going back to work, I said I would go and help and ended up working a night shift. I explained to the employer what I could and couldn’t do and agreed to do 2 more nights. After working the first night I realised I was unable to do it and couldn’t physically manage it so asked employer to cover the 2 nights I had agreed to do as I was still on sick leave and couldn’t manage them. Employer said ‘no chance, no-one to cover, they have been covering for you for last 5 weeks, that’s why I phoned you and asked you when you were coming back’. Where do I stand? I have only been employed for 8 months and know I cannot be sacked while signed off but am worried I am going to be sacked when I go back if I stand up and say ‘ no, I will be back when my sick leave is over’ I am not the only one currently off work at the minute and most of the other staff are taking annual leave so their shifts are having to be covered as well, not just mine. I have to go to the hospital next week and don’t know if he is gonna let me go back to work. Please, can somebody help me? This is really distressing me
