The company is going through restructuring due to a 3 year contract being won. We need to reduce the number of staff on shifts due to the contract amount. We have a person who was promoted to a shift supervisor position but want to demote this employee now as i feel they are not suitable for the role, but has been in the positon for 2 years now. We want to put this employee back to his original role. Which will mean a pay drop ect.

We are currently making all employees re apply for their positions so we can cut the numbers and remove the people we no longer want within the business through this process.

How could we demote this employee back to his original role and put a new employee in his role with having basiclly the same qualifications but with no experiance as a supervisor.

Would the demoted employee have grounds for contstructive dismissal as we have replaced them with a similar candidate?
