I have a TUPEd employee from a Local Authority who is currently on maternity leave. She has requested a career break which we have a policy on – but I was interested to see whether her TUPE conditions remain on her return? She is currently in the Local Government Pension Scheme who informed me that her pension will be cease and she will not be allowed back in the scheme. Surely this is discriminatory? Can anyone advise.
