Q: “One of our employees works for us full-time during the day but also has a part-time job in the evenings. Is this a problem for us? Should we do something about it?”
A: This may be a problem for you in three ways. First you can insist that the employee give up one of the jobs if the other firm is a competitor. Second the evening job may be such a strain that the employee comes to you so tired that he makes mistakes.
In this case you would need to discuss the matter with the employee, point out the problem and make clear that, if mistakes continue to arise, you will have to take action that might result in his dismissal. Third you must ensure that the total hours he works for both companies does not exceed the 48 hour limit set by the Working Time Regulations. If it does, he must reduce the hours of one of the jobs and you are entitled to insist that it is not yours.
