Any Answers answered: Making pregnant employees redundant

Q – A friend works for a business that has two customer service
teams – these are headed up by two managers – she is one of
them. It has been hinted for a long time that the other manager
would be ‘sacked’ and they would head up the teams with just one
manager.

Since that time, my friend has fallen pregnant and both the
managers have been notified of redundancy. There will be an
opportunity, however, for her to apply for the new role
alongside her colleague.

My friend is due to go on maternity leave in a week with a due
date of three weeks – the situation is very stressful for her –
what can she do?

A – This company are on dodgy ground. If they are considering
making your friend redundant due to her pregnancy (and they
would have to show this at tribunal) this is automatic unfair
dismissal and sex discrimination. If, however, the company can
prove the situation is genuine she could receive maternity pay
and redundancy pay. The company needs to be able to clearly
justify the new structure and the reasons for the redundancy.
