Q: “One of our supervisors has been called up for jury service. What are our rights in this matter as his employer?”

A:

  • You must not prevent the employee from attending otherwise you will be in contempt of court and could go to prison.
  • You must not take any detrimental action against the employee.
  • You are not obliged to pay the employee though many employers continue to pay wages reduced by the amount of juror allowances to which the employee is entitled.
  • You could make a plea to the court to postpone the employee's attendance because of the impact on the business but by definition this is just a delaying action so you may feel it better to get the thing out of the way now.
