Q: “An employee has been diagnosed with MS. It is not obvious to anyone at work at present but is likely to become so as it develops. At what point does she become protected by the Disability Discrimination Act?”
A: She already is protected. Certain progressive ailments such as MS and cancer bring the person into protection by the Act as soon as they are diagnosed. You therefore need to begin thinking about how you will accommodate the woman as the illness develops.
