I have a friend at another company who is being transferred from an hourly salary to a commission only wage.

He is currently earning minimum wage and I’m not sure how he would have the opportunity to earn much more given the nature of the business he is employed in. We all know that commission based salaries are an incentive to increase competition and work harder but I’m not sure there would be many more opportunities than he and his colleagues are already taking advantage of.

My questions are: What’s his position legally if his commission does not reach minimum wage?

Does the minimum wage law even apply here?
