Hello,
I am currently dealing with a pregnancy employee who is on a work permit which is due to expire on 21st November 2007. Her baby is due on 9th September 2007 and she will qualify for maternity leave and pay. She has indicated that she will not be returning to the organisation after her maternity leave and is likely to return to Australia where she is from.
I have two questions:
1) As she qualifies for maternity pay, if she remains in the country would we need to pay the full 39 weeks or just for the weeks up until her visa expires?
2) If she decides to return to Austrialia, would we be required to continue to pay maternity pay to her?
Any help would be greatly appreciated
