We have an employee who is coming back to work following an extensive period of sickness absence (over 6 months).
We provide 20 days holiday plus public holidays. Does the time he has had off effect his holiday day allowance? If he is still entitled to this, as we offer more than the statutory minimum (which I understand is 24 days) can we reduce his holiday to the statutory minimum? If so would we minus the remaining public holidays in the year from this?
I’ve done some reading on the internet and this area still seems contested however maybe someone here has some advice?
