I have 45 staff who work contractually at non-specific sites. They might work at one place for years then suddenly I need to change them. I have one employee who was not managing at a site with lots of walking and her sight problems made it more difficult at that site. I changed her (without consulting her) to another site to her benefit in my opinion.
My other staff have moved around regularly but I have tried to leave her there to accomodate her disabilities. Now that I have moved her she is creating a fuss. I have never made any difference to her disbility in the past.
I am treating her the same as everyone else but I apologised for not consulting her.
I have moved her because she is not managing at the other site but have not had a chance to explain the circumstances of the change. I am trying to keep her in a job but she thinks I am trying to get her out.Could she get me for constructive dismissal if I have not been consulting her?
