I have been given the task of checking through all employees contracts before we go through TUPE as the company did not have a personnel department before little old me!! I have found that some contracts contradict what we have in place now eg. states that for shift workers, if allocated by their shift pattern, bank holidays are paid at treble time and for employees on their rest days, a day in lieu is paid. This would be correct if we worked but at present, we don’t work bank holidays and they are paid at normal time and employees on their rest days are also paid at normal time. Will a letter on file suffice or does a complete new contract have to be issued.
