I have a client (hairdressing company) who trains new recruits for up to 2 years which costs them upwards of £2000. They are fed up with people leaving them at the end of the training. Although they have a clawback clause in the contract it is proving difficult and time consuming to enforce.

They are thinking of holding back a certain amount of money from their wages (new recruits only – it wouldn’t affect current trainees) and giving it to them in a lump sum say 6 months after qualification. If they leave before then, they wouldn’t get the lump sum.

Is that legal?
