We have 3 employees outsourced to a company on 16month fixed term contracts, with no terms of notice offered.
The job for which they were contracted for is ending 4 months early.
We have found alternative work for them 45miles away, for a different a company.
We are worried however, as despite including always a general mobility clause within our contracts, The 16month fixed term contract clearly states the place of work and company to which the employees are out sourced to.
Could the employees use this to void the mobility clause?
claim a breach of trust, as no likelyhood of relocation was given to them?
would asking employees to relocate for only 4 months be deemed unreasonable?
Could they claim redundancy on the basis that the original job and conditions they signed the 16month contract for have ended?
