If a firm’s holiday period runs from 1 April to 31 March and an employee is contractually entitled to received 20 days paid annual leave. The firm is also closed between 24th December and 1 January and any working days falling in that period is treated as additional annual leave.

Question 1

If an employee is pregnant and is expecting her baby in August. If between April and August she wants to use up her paid annual leave for example if she has another child and needs time off between April and August, is she contractually entitled to use up her full 20 days before going on maternity leave in August or is she entitled to only use 4/12th of the 20 days i.e 6 days only.

Question 2

As she will be receiving statutory pay in December, can she get paid for the annual leave that falls during the Christmas period.
