Maternity holiday pay – not returning after leave

A lady decided to take extended maternity, then changed her mind and has handed in her 3 months notice to say she will not return.

She is now asking for the full years holiday pay. She left end of Dec 07 to reurn end of Dec 08.

I was under the impression that holiday pay is calculated over the SMP period, but if you decide to take addittional, then resign, that holiday pay would not cover the 52 weeks.

I know these questions fly around alot, but after trawling a few sites etc i would really appreciate your advice – really dont want to get this one wrong!
